These Terms and Conditions govern your access to and use of the GibFlow mobile application operated by Gib Flow Ltd (“we”, “us”, “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
Eligibility
You must be at least 16 years old to use the App. If you are under 18, you must confirm that you have permission from a parent or legal guardian.
You must provide accurate, current, and complete information when creating an account.
User Accounts
To access certain features — including secure bicycle parking — you must create an account.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities carried out under your account
- Ensuring your account information remains accurate
We reserve the right to suspend or terminate accounts that violate these Terms.
Transport & Real-Time Bus Information
The App may display bus routes, stop locations, timetables, and real-time tracking information.
You acknowledge that:
- Real-time bus tracking (where available) relies on third-party data sources
- Delays, inaccuracies, or service disruptions may occur
- GibFlow does not guarantee accuracy, completeness, or uninterrupted availability of transport data
Users should independently verify critical travel information.
Fees and Payments
Certain services may require payment (currently a one-time fee of £1.69 for secure parking bookings).
By making a booking, you agree to:
- Pay all applicable fees displayed at the time of booking
- Provide valid payment information
All payments are non-transferable. Refund policies (if applicable) will be clearly stated within the App. We reserve the right to modify pricing with reasonable notice.
Acceptable Use
You agree not to:
- Use the App for unlawful purposes
- Attempt to gain unauthorised access to facilities or systems
- Interfere with the App’s functionality or security
- Reverse engineer or copy the App’s software
- Share digital access credentials
We may suspend or permanently terminate access for breaches.
Data Protection & Privacy
Your personal data will be processed in accordance with our Privacy Policy and applicable data protection laws in Gibraltar.
This may include:
- Account registration data
- Booking history
- Location data (where permission is granted)
- Access logs for secure facilities
By using the App, you consent to such processing as described in the Privacy Policy.
Intellectual Property
All content, branding, logos, software, and design elements within the App are owned by or licensed to Gib Flow Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
Service Availability
We aim to ensure continuous availability but do not guarantee uninterrupted service.
We may:
- Modify, suspend, or discontinue features
- Perform maintenance or updates
- Introduce new functionality
We are not liable for service interruptions beyond our reasonable control.
Limitation of Liability
To the fullest extent permitted by law:
- GibFlow shall not be liable for indirect, incidental, or consequential damages
- Our total liability arising out of or relating to the App shall not exceed the total amount paid by you in the preceding 12 months (if any)
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded under Gibraltar law.
Indemnity
You agree to indemnify and hold harmless Gib Flow Ltd from any claims, damages, losses, or expenses arising from:
- Your misuse of the App
- Your breach of these Terms
- Your violation of any applicable law
Termination
We may suspend or terminate your access:
- If you breach these Terms
- If required by law
- If we discontinue the service
You may stop using the App at any time.
Changes to These Terms
We may update these Terms from time to time. Updated Terms will be published within the App with a revised “Last Updated” date. Continued use of the App constitutes acceptance of the updated Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of Gibraltar. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gibraltar.
Secure Bicycle Parking
GibFlow lets you book secure bicycle parking slots in advance through the App. The App acts as a digital access key to unlock and access participating facilities.
Access is granted only:
- For the duration of the confirmed booking
- To the registered account holder
You must not share, transfer, or misuse digital access credentials.
User Responsibilities
You agree that:
- You are responsible for securing your bicycle appropriately within the facility
- You will not store prohibited, illegal, hazardous, or dangerous items
- You will comply with all posted rules at the facility
Liability for Stored Property
While reasonable security measures are implemented, GibFlow does not guarantee prevention of theft, damage, or loss. Use of secure bicycle parking facilities is at your own risk.
To the fullest extent permitted by law, we are not liable for:
- Theft or attempted theft
- Damage to bicycles, e-scooters, or other property
- Loss of personal belongings
Nothing in these Terms excludes liability where such exclusion would be unlawful under Gibraltar law.
